Can I Set Up A Limited Company While In The UK On A Tier 2 General Visa? – The immigration rules layout that you can set up a limited company while living in the UK on a Tier 2 General Visa, as this would not necessarily affect your immigration status (as long as you were not actively working in the business).

The trouble with owning a limited company as a Tier 2 General Visa holder is if you decided to try and use this company as your sponsor; the rules state that you must not own more than 10% of the shares of the business that sponsors you (unless you will earn in excess of £165,000 per year). This visa would allow the applicant the opportunity to not only start and own their own business in the UK but also be able to work within it in a full-time capacity. While we do not necessarily want to dissuade you from starting a business as a Tier 2 General Visa holder, you need to be aware of some of the limitations that will be placed on you.

Certificate of sponsorship (CoS) – This isn’t actually a physical certificate but a reference number that is given to your employer once they apply for it. This number will need to be submitted on your application form. Appropriate salary – In order to qualify for Tier 2 (General) your employer must be offering you a job with a minimum salary of £20,500.

English language – You must be able to demonstrate that you have a good knowledge of the English language.
This can be evidenced by passing an approved English language test with at least CEFR level B1 in reading, writing, listening and speaking.

However, you may not have to take the English language test if you have an academic qualification that was taught in English and is equivalent to a UK bachelor’s degree. If you are a national of a predominantly English speaking country you will not need to take the language test.

Work

If you have obtained any form of work visa (e.g. Tier 2 (General), Tier 5 (Government Authorised Exchange)) then you are allowed to study either full- or part-time in the UK. However, the immigration rules state that in order to obtain leave in one of these categories you “must intend to work”.

If you are in the UK with leave as a Points Based System (PBS) Dependant (for example, your partner has a Tier 4 or Tier 2 visa) then you can usually work or study while you are in the UK. You will be allowed to study part-time or full-time. More information on dependants is available here.

In both cases : if you are a part-time student and your employment / dependant visa runs out before the end of your course, you cannot switch into a Tier 4 Student visa in order to complete your studies, as Tier 4 Student visas are only for full-time students. A UK Tier 2 Visa holder can apply for their unmarried partner/civil partner/spouse and dependent kids to join them in the UK. The dependents’ period of leave will be the same as that of the principal Tier 2 applicant. They will also be in a position to work in the UK without any curbs.
